Tuft Terms of Use

Effective August 10, 2026

These Terms of Use (“Terms”) are an agreement between you and Firewood, Inc. (“Firewood,” “we,” “us,” or “our”). By accessing or using Tuft and related services (the “Service”), you agree to these Terms. If you do not agree, do not use the Service.

Early-access service

The Service is experimental, pre-release software. It may be incomplete, unreliable, unavailable, changed, or discontinued at any time. Do not rely on it for emergencies, safety-critical activity, or as the sole copy of any data. You are responsible for backups and for evaluating whether the Service is appropriate for your use.

Eligibility and access

You must be legally able to enter this agreement and at least 13 years old. You are responsible for devices, machines, credentials, connection codes, and activity under your access. Keep credentials confidential and notify us promptly of suspected unauthorized use.

Acceptable use

You may use the Service only for lawful purposes and only with systems and data you own or are authorized to access. You may not interfere with the Service; bypass security or access controls; probe or access another person’s systems without authorization; distribute malware; infringe rights; or use the Service in violation of law. We may suspend or terminate access to protect the Service, users, or others.

Your machines and content

You retain your rights in your machines, software, and data. You grant us only the limited rights necessary to operate the Service at your direction. You are responsible for your content, configurations, software, and compliance with third-party terms and applicable law.

Our software

Firewood and its licensors own the Service and related software, excluding your content. Subject to these Terms, Firewood grants you a limited, revocable, non-exclusive, non-transferable right to use the Service for its intended purpose. No other rights are granted.

Third-party services

The Service may interoperate with third-party devices, networks, software, or services. Firewood does not control and is not responsible for them. Your use of third-party services is governed by their terms.

Privacy

Our Privacy Policy explains how we handle information. By using the Service, you acknowledge that policy.

Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” FIREWOOD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, SECURITY, RELIABILITY, AND AVAILABILITY. FIREWOOD DOES NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR THAT DATA WILL NOT BE LOST OR EXPOSED.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIREWOOD AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, GOODWILL, USE, OR DATA. THEIR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FIREWOOD FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR (B) US$100. These limits apply regardless of the theory of liability and even if a remedy fails of its essential purpose. Some jurisdictions do not allow certain exclusions or limits, so they apply only to the extent permitted by law.

Indemnity

To the extent permitted by law, you will defend, indemnify, and hold harmless Firewood and its officers, directors, employees, contractors, affiliates, and licensors from claims, losses, and expenses (including reasonable legal fees) arising from your unlawful use of the Service, your content, or your violation of these Terms or another person’s rights.

Termination

You may stop using the Service at any time. We may suspend or terminate the Service or your access at any time, including for security, legal, operational, or policy reasons. Provisions that by their nature should survive termination will survive, including ownership, disclaimers, liability limits, indemnity, and governing law.

Governing law

These Terms are governed by Delaware law, without regard to conflict-of-law rules. The state and federal courts located in Delaware will have exclusive jurisdiction, except where applicable consumer law requires otherwise.

Changes and general terms

We may update these Terms by posting a revised version and updating the effective date. If a change is material, we will provide additional notice when required by law. If any provision is unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, financing, merger, acquisition, or sale of assets. These Terms are the entire agreement between you and Firewood concerning the Service.
